SECTION II: OBJECT OF THE CONCESSION
II.1) Description of the concession
II.1.1) Title attributed to the concession contract by the contracting authority:
public service delegation on casino operations in accordance with Articles L. 1411-1 to L. 1411-1418 General Code of Local Authorities.

delegation agreement public service that focuses on the operation of the casino.
Candidates admitted to tender offer property solutions (leasing, building …) for providing the services required in the municipal area. The methods of financing and payment of the delegate are delegated management of public service with a fee only related to operating results.
The levy municipal and financial contribution for the benefit of the delegate of the Commune on the one hand, and pricing practiced in different sectors of operating other hand, determine the general structure of this contract. The levy will be 15% of gross gaming revenue, as calculated under the provisions of the amended Article 15 of Decree No. 59-1489 of 22 décembre1959, and after application of the various reliefs under the legislation and regulations in force .

II.2) Quantity or scope of the concession contract
II.2.1) Total quantity or scope: term: 20 years. Main services entrusted to the delegate: “establishment of a diverse range of games (table games and slot machines)-proposal of a diverse range of restaurants and quality likely to retain customers of the casino-organization of shows & events Various (film and theater open to the public, disco dancing, entertainment …)- keeping in perfect condition of the property to ensure the attractiveness of the institution-development of promotional & communication designed to promote building games and its ancillary activities contributing to the spread of the city and its tourist appeal (organization or support of a sporting event such as golf tournaments, equestrian event …, organizing a music festival fame national or international). All facilities of the casino is owned by Tourism Spa and Hotel de Divonne (Divonne tth), a subsidiary of the group Partouche (operating company). Number of employees: about 350, about 140 attached to the games. The tenement housing on which are built the casino, theater space Charles Aznavour, The Grand Hotel is in the following areas: land-surface horizontal condominium: 50697m (tth and residence of the park)-surface of freehold land : 16752m. TOTAL 67449m. Gambling activities consist of:-the number of slot machines allowed: 355 – number of slot machines in operation: 336 – room size machines sous6: 980m-different games played in the playroom Traditional English & French Roulette , black jack, poker and Texas Hold’em Stup poker. TTH manages the 4 restaurants, 4 bars, a 4-star hotel with 134 rooms, a theater and cinema of 153 seats, an auditorium of 1 100-2 000 seats, 21 meeting rooms, a 18 hole golf. Forecast period for commencing the service: 01/11/2008.

III.1) Conditions for participation
III.1.1) Personal situation of economic operators, including requirements relating to the registration of a trade or professsion:
Information and formalities necessary for evaluating if requirements are met:
- Part 1: A letter of application;
- Part 2: A sworn statement attesting that the candidate has not been over the last five years of a conviction recorded in Notice No. 2 of the criminal offenses referred to in Articles L. 324-9 and L. 324-10, L. 341-6 and L. 125-3 of the Labour Code;
- Part 3: A sworn statement, dated and signed, certifying compliance by the candidate of the obligation to employ disabled workers laid down in Article L. 323-1 of the Labour Code;
- Part 4: certificates justifying the candidate is in good standing to its fiscal and social obligations (proof required by Decree No. 97-638 of 31 May 1997 and the decree of January 31, 2003 as amended) to December 31, 2007 .
Candidates’ attention is drawn to the fact that production of all documents referred to above is required in case of consortium, each member of the group.

IV.1) Criteria attributionsur the basis of application submitted, applicants will be selected with regard to their professional and financial guarantees, their ability to ensure equality before the public service users and the continuity of that contracts and their compliance with the obligation to employ disabled workers.
The bids submitted by the applicants selected by the contracting authority will be judged on the following criteria:
quality of service offered, adequacy of resources to service objectives, financial interests and technical merit of the proposed project.

The Pre-Instance against the procedure initiated by the contracting authority may be brought before the contract as provided for in Article L551-1 of the Code of administrative justice.
The acts of the contracting authority in connection with this procedure may also be a remedy for abuse of power tends to cancel them within 2 months of their notification or publication as provided by Article R421-1 of the Code of administrative justice. Where necessary the appeal may be accompanied by an interim suspension (Article L521-1 of the Code of Administrative Justice).
The contract at the end of this procedure may be an automatic appeal by any contestant ousted. This appeal must be lodged within 2 months of advertising that will be made of the signing of the contract. Where necessary the appeal may be accompanied by an interim suspension.
